Do You Need Planning Permission for a Boiler Replacement or Heat Pump?

One of the most common questions homeowners ask when considering a new heating system is whether they will need planning permission. It is a fair concern – the last thing anyone wants is to invest in a new boiler or heat pump only to discover they needed approval first. The good news is that in most cases, the answer is straightforward. Here is what you need to know.

Replacing Your Boiler – Do You Need Planning Permission?

For the vast majority of homeowners, replacing a like-for-like boiler does not require planning permission. Swapping an old gas boiler for a new gas model, or an oil boiler for a modern equivalent, is considered routine maintenance and falls under permitted development rights.

This applies whether the boiler is wall-mounted inside your home or housed in an external boiler room. As long as the replacement is similar in nature to the original, you can generally go ahead without any planning application.

There are a couple of exceptions worth knowing about:

  • Listed buildings – Any changes to a listed building, including heating system replacements, may require listed building consent. Always check with your local planning authority before proceeding.
  • Conservation areas – If your property sits in a conservation area, certain external changes may be subject to restrictions. It is worth checking whether a new flue position or any external pipework could be affected.

What About Air Source Heat Pumps?

Air source heat pumps are installed externally, which makes planning permission a more relevant question. The good news is that in England, ASHPs fall under permitted development rights for most domestic properties – meaning no planning application is needed, provided certain conditions are met.

Under current permitted development rules, your installation must:

  • Be the first heat pump installed at the property
  • Not be located on a pitched roof or flat roof
  • Be sited at least one metre from the property boundary
  • Not be installed on a site designated as a scheduled monument
  • Not exceed 42 decibels when measured one metre from a neighbour’s nearest window or door

If your property meets these criteria, your installer can proceed without planning permission. If any condition cannot be satisfied, a planning application will be required before installation begins.

Listed Buildings and Conservation Areas – Heat Pumps

As with boilers, listed buildings and conservation areas require extra consideration. Permitted development rights do not apply to listed buildings, and in some conservation areas, additional restrictions may be in place. Your installer or local planning authority will be able to advise you on the specific requirements for your property before any commitment is made.

What About MCS Certification?

Planning permission and MCS certification are separate requirements, but both matter. Any heat pump installation used to claim the Boiler Upgrade Scheme grant must be carried out by an MCS-certified installer. MCS (Microgeneration Certification Scheme) accreditation ensures installers meet strict standards of competence and workmanship – and it is your assurance that the job has been done properly.

Do You Also Need Building Regulations Approval?

Planning permission and building regulations are different things, and it is worth understanding both. Whilst you may not need planning permission, boiler replacements and heat pump installations are generally subject to building regulations to ensure work is carried out safely and to the required standard. Your qualified installer will handle the necessary notifications on your behalf.
